1. General Terms and Conditions

1.2 The following General Terms and Conditions of www.baviette.com in the version valid at the time of the order. Deviating terms and conditions do not apply.

1.3 Purchases in our online shop are possible from the age of 16. Our offers are aimed at customers in Germany; we make our offers available to customers residing or having their registered office in the EEA under the same conditions due to the EU Geoblocking Regulation (Regulation (EU) 2018/302); the same applies to customers residing or having their registered office in Switzerland.

1.4 Our offers are directed at consumers within the meaning of Section 13 of the German Civil Code (BGB). A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity. An example of this is orders in quantities exceeding normal household quantities. We reject these orders. These are referred to below as "customers"/"private customers" or "consumers."

1.5 We also sell to businesses, i.e., natural or legal persons or partnerships with legal capacity who, when entering into a legal transaction, are acting in the exercise of their commercial or independent professional activity (Section 14 of the German Civil Code). These Terms and Conditions also apply to businesses, subject to some different conditions, which will be specifically noted. These are referred to below as "business customers."

By clicking the "Buy now" button, you place a binding order for the items in your shopping cart. We will confirm receipt of your order immediately by email after you have submitted it. A binding contract is concluded upon receipt of the order confirmation. Please note that in the case of advance payment (reservation), the ordered goods will not be delivered until we have received the full purchase price and any shipping costs. Therefore, we ask you to transfer the purchase price immediately after receiving the order confirmation, but no later than within 7 days.

1.4 You agree to the assignment of the Seller’s claims for payment of the purchase price to third parties, in particular to Baviette Payments GmbH.

1.5 If you choose to offset the carbon footprint of your order on the order summary page, this will become part of the contract for your order. You will be informed of the amount of the contribution on the order summary page before the contract is concluded.

1.6 Please note that, in exceptional cases, we are not obligated to deliver the ordered goods if we have properly ordered the goods but have not been delivered correctly or on time (congruent hedging transaction). A further prerequisite is that we are not responsible for the unavailability of the goods and have informed you of this fact promptly. Furthermore, we must not have assumed the procurement risk for the ordered goods. In the event of such unavailability of the goods, we will promptly refund any payments already made.

1.7 We assume no procurement risk for ordered goods (procurement risk). This also applies to orders for goods placed solely on the basis of a description and illustrations in the online shop. We are only obligated to deliver the goods from our existing inventory and the goods ordered from our suppliers, provided that these deliveries are made through no fault of our own. Should the goods be unavailable from our suppliers, we reserve the right to withdraw from the delivery obligation. In this case, we will inform you immediately of the unavailability and refund any consideration already paid without delay.

1.8 The delivery time is specified on the respective offer page. If no information about the delivery time is provided, the standard delivery time is 3-5 working days from the day after the order confirmation. Please note that no deliveries are made on Sundays and public holidays.

1.9 Shipping costs will be clearly communicated to you before completing the purchase process. We offer free shipping for orders within Germany above a certain order value. For deliveries outside Germany, additional shipping costs may apply, which will be clearly communicated before the contract is concluded.

1.10 You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period shall expire after fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods. To exercise your right of cancellation, you must notify us of this by means of an unambiguous declaration (e.g., a letter sent by post, fax).
