1. General terms of business and conditions

1.2 For your orders in our online shop, the following General Terms and Conditions of www.baviette.com apply exclusively in their current version at the time of the order. Any terms and conditions that deviate from the following provisions shall not apply.

1.3 Purchases in our online shop are possible from the age of 16. Our offers are aimed at customers in Germany, we provide our offers to customers with residence or business domicile in the territory of the EEA due to the EU Geoblocking Regulation (Regulation (EU) 2018/302) under the same conditions; the same also applies to customers with residence or business domicile in Switzerland.

1.4 Our offers are addressed to consumers within the meaning of § 13 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An indication of this are, for example, orders of more than the usual household quantities. We reject these. In the following, these are referred to as "customers"/"private customers" or "consumers".

1.5 In addition, we also sell to entrepreneurs, i.e. a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity (§ 14 BGB). For entrepreneurs, these GTC also apply under partly deviating conditions, to which separate reference is made. In the following, these are referred to as "business customers".

By clicking the "buy now" button, you place a binding order for the items in the shopping basket. We will confirm receipt of your order immediately by email after you have sent the order. A binding contract is concluded upon receipt of the order confirmation. Please note that in the case of advance payment (reservation), the ordered goods will be delivered as soon as we have received payment of the full purchase price and any shipping costs. Therefore, we ask you to transfer the purchase price immediately after receipt of the order confirmation, but within 7 days at the latest.

1.4 You agree to the assignment of the Seller's claims for payment of the purchase price to third parties, in particular to Baviette Payments UG.

1.5 If you choose to offset the carbon footprint of your order on the order overview page, this will form part of the contract for your order. You will be informed about the amount of the contribution before the conclusion of the contract on the order overview page.

1.6 Please note that we are exceptionally not obliged to deliver the ordered goods if we have duly ordered the goods on our part but have not been supplied correctly or on time (congruent covering transaction). A further prerequisite is that we are not responsible for the lack of availability of the goods and have informed you of this circumstance without delay. In addition, we must not have assumed the risk of procuring the ordered goods. In the event of corresponding unavailability of the goods, we will immediately reimburse you for any payments already made.

1.7 We do not assume the risk of having to procure ordered goods (procurement risk). This also applies to orders for goods which are only described in terms of their type and characteristics (generic goods). We are only obliged to deliver from our stock of goods and the goods ordered by us from our suppliers. We deliver orders within Germany and certain EU countries. If working days are specified as deadlines, we understand this to mean all days from Monday to Friday inclusive, with the exception of public holidays.

1.8 You will be informed about the delivery time on the respective product detail page and before placing the order.

1.9 We reserve the right to refuse an order or to cancel an order if it has been generated by software, a machine, a crawler, a spider or other automated web program or scipted behaviour system or by the use of third party services used to place the order on your behalf.


2. PRICES, SHIPPING COSTS AND EXPRESS DELIVERY

2.1 The prices listed in the offer at the time of the order shall apply. The prices stated are final prices, i.e. they include the applicable German statutory value added tax. The goods remain our property until the purchase price has been paid in full.

2.2 We will pay the shipping costs for you, except in the case of express shipping, or if otherwise stated (see also the further provisions of this clause 2.3).

2.3 The shipping costs result from the size of the order, among other things the shipping, handling and other services. The costs are incurred and charged by Baviette.

2.4 We offer express shipping for certain orders. You can see whether this option is offered for your particular order and the costs incurred for this in the order process. The goods will be delivered within 2 working days at the latest. If this delivery time is exceeded, you will of course be refunded the delivery costs.


3. cancellation policy

Right of withdrawal

You have the right to cancel the contract with us or another seller within fourteen days without giving any reason.

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods.

To exercise your right of withdrawal, you can inform us (Baviette UG), 25421 Pinenberg, Tel.: +49 4101 3957558, e-mail address: info@baviette.com) of your decision to withdraw from the contract by means of a clear declaration (e.g. an e-mail). You can use the attached model cancellation form for this purpose, which is, however, not mandatory.

If you make use of this option, we will send you confirmation of receipt of such revocation without delay (e.g. by e-mail).

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of the revocation

If you revoke the contract, we will have refunded to you all payments made, which we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered), without delay and at the latest within fourteen days from the day on which your revocation of the contract was received. The same means of payment that you used for the original transaction will be used for this repayment, unless expressly agreed otherwise with you; in no case will you be charged for this repayment. Unless collection of the goods has been offered, repayment may be refused until the goods have been returned or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return the goods to the respective seller's return address without undue delay and in any case no later than fourteen days from the day on which you were informed of the revocation of the contract, unless it was offered that the respective goods would be collected from you. The deadline is met if you send the goods before the end of the fourteen-day period. Here you can retrieve your return label for many items and, in the case of forwarding shipments, view the contact details of the forwarding agent.

The respective seller bears the costs for returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling the goods in a way that is not necessary for checking the condition, properties and functioning of the goods. If you have demanded that services for which payment of a price is provided should begin before the end of the withdrawal period, you must pay a reasonable amount corresponding to the proportion of the services already provided up to the time of withdrawal compared to the total scope of the services provided for in the contract.


4. non-existence of the right of withdrawal: Pursuant to Section 312g (2) of the German Civil Code (BGB), a right of withdrawal does not exist, inter alia, for contracts for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer and it expires prematurely for contracts, sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.


9. validity of the prices: The prices stated on www.baviette.com are Euro prices (incl. statutory tax).

10 Delivery and shipping costs: When ordering items from different sellers, you will generally receive several deliveries. The shipping method (parcel or forwarding agency) and the delivery conditions (in the case of forwarding agency shipping) are part of the item information on the item detail page. The respective shipping costs of your order are listed in the shopping cart and in the overview before clicking the button "Order now at the stated price". 11.

11 Payment: You can pay in advance, by direct debit, on account or by instalment.

In order to be able to offer you an attractive range of payment methods at www.baviette.com, we cooperate with various payment service providers. 

We reserve the right to offer you only certain payment methods.

If you are in default with regard to the purchase of an item, we reserve the right to charge a flat rate of € 1.30 for each reminder as compensation for the damage incurred; you are free to prove that we have incurred no or only minor damage. In addition, we may charge you statutory interest on arrears at a rate of five percentage points above the base interest rate.

In individual cases, we reserve the right to deliver the goods only after a down payment has been made. After receipt of the order, we will coordinate this with you.

12. retention of title: The goods remain the property of the respective seller until full payment has been made.

13. alternative dispute resolution: The EU Commission offers the possibility of online dispute resolution on an online platform operated by it. This platform can be reached via the external link https://ec.europa.eu/consumers/odr/. We are not obliged and unwilling to participate in dispute resolution proceedings before a consumer arbitration board. The same applies to the other sellers.

14. contract language/storage of the order text: The contract is concluded in German. The text of the contract will not be stored by us after conclusion of the contract. The details of your order will be made available to you in the order confirmation sent by e-mail. These General Terms and Conditions are also included in the order confirmation.

15 Applicable law: The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer domiciled outside the Federal Republic of Germany, the law of the country in which you are domiciled may also apply if it is a matter of mandatory provisions.
